Advancements in novel neurotechnologies, such as brain computer interfaces and neuromodulatory devices such as deep brain stimulators, will have profound implications for society and human rights. While these technologies are improving the diagnosis and treatment of mental and neurological diseases, they can also alter individual agency and estrange those using neurotechnologies from their sense of self, challenging basic notions of what it means to be human. As an international coalition of interdisciplinary scholars and practitioners, we examine these challenges and make (...) recommendations to mitigate negative consequences that could arise from the unregulated development or application of novel neurotechnologies. We explore potential ethical challenges in four key areas: identity and agency, privacy, bias, and enhancement. To address them, we propose democratic and inclusive summits to establish globally-coordinated ethical and societal guidelines for neurotechnology development and application, new measures, including “Neurorights,” for data privacy, security, and consent to empower neurotechnology users’ control over their data, new methods of identifying and preventing bias, and the adoption of public guidelines for safe and equitable distribution of neurotechnological devices. Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. What happens at the end of a clinical trial for an investigational neural implant? It may be surprising to learn how difficult it is to answer this question. While new trials are initiated with increasing regularity, relatively little consensus exists on how best to conduct them, and even less on how to ethically end them. The landscape of recent neural implant trials demonstrates wide variability of what happens to research participants after an neural implant trial ends. Some former research participants (...) continue to receive support for their devices (e.g., battery and component replacements, software updates, etc.). Others, when safe, have their neural implants removed through surgical explantation. Still others continue to live with a deactivated neural implant embedded in their body. In the United States, there are no uniform requirements to provide services, of any kind, after an neural implant study ends, and other nations are similarly facing this challenge. The existence of a post-trial gap in an expanding neural implant research ecosystem invites obvious questions: What is owed to neural implant research participants post-trial, and why has providing it been so difficult to accomplish in practice? To take a step forward on this difficult issue, we assembled one group of stakeholders – researchers funded for neuroethics grants by the National Institutes of Health – to explore possible starting points on one topic: ethical guidance for post-trial care of research participants in neural implant trials. Based on shared concerns discussed in the expert workshop the current paper is a call to action. It reports the key areas of convergence from the meeting and highlights important next steps towards developing much needed guidance. (shrink)

A superconducting transition temperature as high as 100 K was recently discovered in one monolayer FeSe grown on SrTiO3. The discovery ignited efforts to identify the mechanism for the markedly enhanced Tc from its bulk value of 8 K. There are two main views about the origin of the Tc enhancement: interfacial effects and/or excess electrons with strong electron correlation. Here, we report the observation of superconductivity below 20 K in surface electron-doped bulk FeSe. The doped surface layer possesses all (...) the key spectroscopic aspects of the monolayer FeSe on SrTiO3. Without interfacial effects, the surface layer state has a moderate Tc of 20 K with a smaller gap opening of 4.2 meV. Our results show that excess electrons with strong correlation cannot induce the maximum Tc, which in turn reveals the need for interfacial effects to achieve the highest Tc in one monolayer FeSe on SrTiO3. Motivated by problems that arise in computing degrees of belief, we consider the problem of computing asymptotic conditional probabilities for first-order sentences. Given first-order sentences φ and θ, we consider the structures with domain {1,..., N} that satisfy θ, and compute the fraction of them in which φ is true. We then consider what happens to this fraction as N gets large. This extends the work on 0-1 laws that considers the limiting probability of first-order sentences, by considering asymptotic conditional (...) probabilities. As shown by Liogon'kii [24], if there is a non-unary predicate symbol in the vocabulary, asymptotic conditional probabilities do not always exist. We extend this result to show that asymptotic conditional probabilities do not always exist for any reasonable notion of limit. Liogon'kii also showed that the problem of deciding whether the limit exists is undecidable. We analyze the complexity of three problems with respect to this limit: deciding whether it is well-defined, whether it exists, and whether it lies in some nontrivial interval. Matching upper and lower bounds are given for all three problems, showing them to be highly undecidable. (shrink)

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

The I Ching, or Book of Changes, has been one of the two or three most influential books in the Chinese canon. It has been used by people on all levels of society, both as a method of divination and as a source of essential ideas about the nature of heaven, earth, and humankind. During the eleventh and twelfth centuries, Sung dynasty literati turned to it for guidance in their fundamental reworking of the classical traditions. This book explores how (...) four leading thinkers — Su Shih, Shao Yung, Ch’eng I, and Chu Hsi — applied the I Ching to these projects. These four men used the Book of Changes in strikingly different ways. Yet each claimed to find in it a sure foundation for human values. Their work established not only new meanings for the text but also new models for governance and moral philosophy that would be debated throughout the next thousand years of Chinese intellectual history. By focusing on their uses of the I Ching, this study casts a unique light on the complex continuity-within-change and rich diversity of Sung culture. (shrink)

Harold Laski (Manchester, 1893-Londres, 1950) es de los pocos teóricos del Estado en el mundo anglo-sajón que, desde John Stuart Mill, merece ser recordado. Sus teorías se desenvuelven en el tránsito del pensamiento liberal a la acción de tipo socialista. Fue miembro de la renombrada Fabian Society aunque renunció a su puesto en el Comité Ejecutivo Fabiano aduciendo incompatibilidad de opiniones, pues no aceptaba la posición "gradualista" y evolucionista de la socialdemocracia. Además formó parte del comité ejecutivo del partido laboralista (...) -aunque con serias disensiones con el premier MacDonald-, que debería estudiar los cambios originados en la acción socialista tras la primera Guerra Mundial. A su renombre puede haber ayudado el hecho de haber enseñado en las prestigiosas universidades de Mac-Gill de Montreal y en Harvard. De todas formas, a pesar de ser un pensador que extrajo sus teorías de la práctica y dar a sus aportaciones un contenido pragmático, como Hobbes o Locke, no se puede parangonar en ningún caso con ellos. Se trata -a pesar de sus bandazos- de un intelectual independiente de izquierda, postura que afirmó en su pertenencia al partido laborista. De esta suerte su teoría política pudo fundarse en la ética, que como se verá no se deja entremezclar con el materialismo histórico marxista. El Estado en la teoría y en la práctica corresponde al período en el que busca un acomodamiento de la teoría del Estado a las nuevas circunstancias, una fase que el autor inicia en la década de los treinta del siglo XX. Es un libro que desarrolla y amplía, como él deja claro, su libro anterior, La Democracia en crisis (1933), que también fuera traducido para Revista de Derecho Privado, y supone un perfeccionamiento de sus principios filosóficos. Laski se ocupa de diagnosticar las causas del fracaso y avanza un proyecto de teoría social que se propone desenvolver en el marco de ocho años. Este plan sería corregido después de colaboraciones en simposios y de publicaciones en diversas revistas junto a un grupo de adalides del socialismo, entre los que cabe destacar a Bernard Shaw, J.A. Hobson o Lowes Dickinson entre otros. Este libro, que se vertió al castellano en 1936, fue traducido por Vicente Herrero Ayllón. INDICE. A lo largo de la historia, el devenir de los acontecimientos ha hecho que determinados autores, que quizá en su época gozaron de fama y popularidad, hayan caído en el olvido o hayan sido forzados al ostracismo. Un caso clásico sería el del poeta y narrador estadounidense William Gilmore Simms quien, antes de la Guerra de Secesión, disfrutó de los laureles de la fama y la admiración de sus contemporáneos. Sin embargo, su apoyo a la causa confederada ha hecho de (...) él un autor prácticamente olvidado hoy en día. El caso de Joseph de Maistre es similar, pues también se enmarca dentro del apoyo a las causas perdidas o, más concretamente, a las causas que, andando el tiempo, no han resultado las vencedoras. Su apoyo a la causa contrarevolucionaria en el momento en que Europa se abría a la contemporaneidad social y política lo ha convertido en una isla en el pensamiento moderno, a pesar de que en su momento fuera un intelectual conocido y un pensador político respetado en los círculos conservadores. Como bien pone de manifiesto la Dra. Guerrero en su introducción, habría que esperar hasta 2007, para que la figura del senador saboyano volviera a los círculos académicos franceses, cuando Philippe Sollers escribió su ya clásico “Elogio de un maldito”. En este artículo se esboza la relación entre la libertad y la moral política en el pensamiento de Joseph Ratzinger. Para ello, se exponen los fundamentos teológicos y antropológicos que justifican el concepto de libertad y el significado de la política como ámbito de la razón moral. Por último, se propone que un adecuado concepto de libertad, cuyo presupuesto es la verdad, facilita la comprensión y el desarrollo de la actividad política a partir de su naturaleza moral.

Le canon 812 du Code de droit canon de 1983 exige que ceux qui enseignent une discipline théologique dans une université catholique aient un mandatum de la part de l’autorité ecclésiastique compétente. Entre insistances et rappels à l’ordre romains, s’en suivirent aux Etats-Unis neuf ans de consultations, discussions et conflits qui impliquèrent évêques, présidents d’universités et théologiens. Il y a là un fait théologique et ecclésial dont les Eglises d’autres pays n’ont pas fait la même expérience. L’examen des enjeux ecclésiologiques (...) de ces péripéties constitue l’objet de ces réflexions qui représentent ainsi une sorte de lettre théologique des Etats-Unis. Pourquoi l’acuité de la question dans ce pays ? Comment comprendre le mandatum avec l’emploi du concept de communion ? Qu’est-ce que ce mandatum comme fait historique et comme institution ecclésiale ? Telles sont les questions auxquelles tente de répondre J.G. Mueller dans cet article.Canon 812 of the Code of Canon Law of 1983 requires that those who teach a theological discipline in a Catholic university have a mandatum from the competent church authority. In between Rome’s insistence and calls to order, there followed nine years of consultations, discussions, and conflicts in the United States involving bishops, university presidents, and theologians. This is a theological and ecclesial fact of which Churches in other countries have not had the same experience. An examination of the ecclesiological stakes of these vicissitudes constitutes the subject of these reflections, which represents a sort of theological letter from the United States. Why the acuity of the question in this country? How can we understand the mandatum by using the concept of communion? What is this mandatum as a historical fact and as an ecclesiastical institution? Des contraintes qui relèvent du conformisme moral et idéologique s'imposent là où il n'y a pas de pouvoir étatique. La survie de l'humanité et la culture ne requièrent pas nécessairement l'Etat, contrairement à ce que pensait Hobbes, mais elles ne vont pas sans normes contraignantes. Celles-ci s'imposent d'autant mieux qu'elles paraissent liees à l'ordre du monde. Dans cet article, j'envisagerai d'abord comment les sociétés sans Etat conservent scrupuleusement les coutumes qui les régissent. C'est le conservatisme des traditions qui permet à (...) ces sociétés de se passer d'un pouvoir séparé d'elles-mêmes. C'est leur refus de reconnaître un tel pouvoir qui les oblige au conservatisme. Je verrai ensuite comment Rousseau qui voulait établir un contrat social sans Léviathan, en arrive également à refuser l'évolution historique et à vouloir instituer ou maintenir une organisation sociale et morale capable d'auto-régulation. En este artículo analizo la aproximación “estética” de Malcolm Budd a la naturaleza, que sostiene que el modo correcto de experimentar la naturaleza es “como naturaleza” y no como arte. Estudio su relación con la idea kantiana de belleza libre y trato de mostrar que la belleza libre es un recurso teórico que deriva de la inevitable belleza dependiente. asimismo, basándome en la filosofía de Joseph Margolis, pretendo mostrar que “la naturaleza como naturaleza” es también un artefacto cultural.

Although clinical ethics consultation is a high-stakes endeavor with an increasing prominence in health care systems, progress in developing standards for quality is challenging. In this article, we describe the results of a pilot project utilizing portfolios as an evaluation tool. We found that this approach is feasible and resulted in a reasonably wide distribution of scores among the 23 submitted portfolios that we evaluated. We discuss limitations and implications of these results, and suggest that this is a significant step (...) on the pathway to an eventual certification process for clinical ethics consultants. By considering the history of bioethics and international humanitarian law, Joseph J. Fins contends that bioethics as an academic and moral community should stand in solidarity with Ukraine as it defends freedom and civility.

Patient narratives from two investigational deep brain stimulation trials for traumatic brain injury and obsessive‐compulsive disorder reveal that injury and illness rob individuals of personal identity and that neuromodulation can restore it. The early success of these interventions makes a compelling case for continued post‐trial access to these technologies. Given the centrality of personal identity to respect for persons, a failure to provide continued access can be understood to represent a metaphorical identity theft. Such a loss recapitulates the pain of (...) an individual's initial injury or illness and becomes especially tragic because it could be prevented by robust policy. A failure to fulfill this normative obligation constitutes a breach of disability law, which would view post‐trial access as a means to achieve social reintegration through this neurotechnological accommodation.
